Prospective investors should note that employment and travel authorization can often be obtained much earlier than the physical Green Card through concurrent filing of an Adjustment of Status. How the EB-5 Visa Program Works

Getting Started – Contact EB5 Development Group

The first step in the EB-5 visa program is to contact us and fill out the eligibility questionnaire. Once completed, we can schedule a meeting to discuss your situation further and give you an in-depth outline of the EB-5 process, our regional center, and the current projects we have available.

Work with an Immigration Attorney

A critical part of the EB-5 application is documenting the Source and Path of Funds. We’ll connect you with an experienced EB-5 immigration attorney for a consultation. With their guidance, you’ll prepare the required documents while we provide the project details needed to file your I-526E petition.

Invest and Apply for Your Conditional Green Card

Once your attorney confirms readiness, you’ll make the investment and file your I-526E petition. Approved investors and their families receive a two-year conditional Green Card, granting the same benefits as permanent residents — including work authorization, freedom to travel, and access to education opportunities.

Apply for Your Permanent Green Card

Before your conditional Green Card expires, your attorney files the I-829 petition to remove conditions. At this stage, the regional center provides proof of investment spending and job creation. Each investor must be credited with 10 U.S. jobs to qualify for approval.

Permanent Residency & Return of Investment

After I-829 approval, you and your family become permanent Green Card holders with a clear path to U.S. citizenship. At this time, investors are typically eligible for the return of their original investment, aligning with real estate development cycles.

Why the EB-5 Program Is Flexible

The EB-5 visa program is one of the most flexible paths to U.S. residency. Investors are not required to manage day-to-day business operations, and they may invest in either a new or existing enterprise. You also do not need to live in the same region where your investment is made — for example, you can invest in one of our EB5 Development Group projects and still choose to live elsewhere in the U.S.

In addition, EB-5 investment funds can come from any lawful source, including gifts, loans, sale of assets, income, inheritance, or divorce settlements.
