The EB-5 process begins when you select a qualified EB-5 project and make the required investment:
After your investment is made, you will file Form I-526E, which proves the lawful source of your funds and outlines how the project will create at least 10 full-time jobs for U.S. workers.

When applying for the EB-5 Visa, investors can choose between two main routes:
1. Regional Center Route
Regional Centers are government-licensed entities that manage EB-5 projects and pool investments from multiple investors. The advantage of this route is that it allows job creation to be measured not only by direct jobs, but also by indirect and induced jobs.
2. Standalone Investor Route
This path is for investors who want to be actively involved in their own EB-5 project or business. Unlike the regional center model, it only counts direct job creation.
To achieve a successful EB-5 petition, investors must clear three major requirements:
Investors must clearly prove to USCIS that their funds are obtained legally and show a transparent path of investment. This is typically documented in the I-526E petition with support from an experienced immigration attorney.
Funds must remain at-risk for the duration of the EB-5 process — meaning there are no guarantees of repayment. While not inherently “risky,” this ensures compliance with program rules. The best safeguard for investors is choosing regional centers with strong repayment track records.
At least 10 full-time jobs must be created and allocated to the investor. When filing the I-829 petition, proof of job creation is required to remove conditions and receive a permanent green card.
